BOOKING TERMS AND CONDITIONS

IMPORTANT ADDITIONAL INFORMATION REGARDING YOUR BOOKING. Please understand that you must not accept any booking unless you understand and agree with the following terms and conditions. Your acceptance of the booking, and payment for the booking, or any part thereof, expressly constitutes your acknowledgement and acceptance of these terms and conditions. If you do not agree with all such terms and conditions stated herein, please do not proceed with the booking or make any payment therefor.

Felix Travel owns and operates the website, the URL of which is www.europecharm.com (hereinafter Felix Travel and the website are referred to collectively as “Felix Travel”).

Baggage Fees: Additional fees for baggage may apply. Please contact your airline or refer to its website for detailed information regarding their checked baggage policies.

Travel Agent: Felix Travel, doing business as and through its website EuropeCharm.com, and its affiliated entities, acts as a travel agent only. We sell various travel related products on behalf of numerous transport service providers, numerous transport and accommodation service providers, including, but not limited to airlines, coach, rail, cruise line operators and hotels. Felix Travel does not own, operate, manage or control these independent suppliers of services and is not liable for their acts or omissions. Felix Travel’s obligations to you are to make travel bookings on your behalf and to arrange relevant contracts between you and the travel service providers. We have no responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standard. A request cannot be guaranteed. All bookings are subject to the terms and conditions and limitations of liability imposed by these travel service providers. You understand that your legal recourse is against the specific provider not Felix Travel.

Important Conditions: Prices are subject to increase prior to the time you make full payment. Prices are not subject to increase after you make full payment, except for charges resulting from increases in government-imposed taxes or fees. As noted above, by making the booking, you expressly acknowledge your acceptance of these conditions (i.e. increases before full payment and increases attributable to government-imposed taxes, fees or carrier imposed surcharges after full payment will be your responsibility) applicable to your purchase.

Cancellation: Please be aware that most travel bookings are non-refundable and cancelled or changed bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Where we incur any liability for a cancellation fee or charge for any booking which you cancel or change, you agree to indemnify us for the amount of that fee or charge.

Payments: You must pay the initial non-refundable fee on the website. By signing the Authorization form electronically, you authorize Felix Travel acting through its website, EuropeCharm.com, to charge your credit card for the cost of the travel reservation and any future travel reservation expenses related to your travel. You will receive an email from us setting out in detail the particular information regarding your travel reservation and the exact amount of the cost. Your consent, via email, will be requested before every travel reservation will be made or before any charge to your credit card will be made. After we receive your email agreement approving the total cost of your travel reservation, Felix Travel will charge your credit card with the approved amount. You will receive an invoice by email after every reservation is made. Felix Travel accepts debit card or credit cards (AMEX, Visa, MasterCard and Discover) and money orders or checks.

Credit Card Transactions: If for any reason, any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the provider, and not against Felix Travel, and in the event that payment has been made to Felix Travel by credit card, you agree that you will not seek to charge back your payment to Felix Travel. If Felix Travel incurs any costs, including but not limited to attorneys’ fees, to recover any payments charged back by your credit card company, you agree that you will be liable for these costs. If the credit card is declined, you guarantee that you will settle any amounts owing to Felix Travel via money order or cashier’s check immediately.

Travel Insurance: For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. However, no representation or description of the insurance made by Felix Travel to you constitutes a binding assurance or promise about the insurance. You will be asked to accept or decline travel insurance when you sign the credit/debit card authorization form. If you wish to purchase the travel insurance, please complete your travel insurance form, sign it and return it to us. Felix Travel is not an insurance company and has no responsibility for the submission, payment or adjustment of any insurance claims. Any claims that may fall under the relevant travel insurance policy must be submitted to the insurance company identified in the policy.

Additional Fees: Additional taxes and surcharges (including carrier imposed surcharges) that cannot be pre-collected may be charged locally by car rental agencies, hotels or other suppliers

Responsibility: We always do our best to make sure your travel arrangements are satisfactory. However, Felix Travel, and its affiliates and their employees, shareholders, subsidiaries, officers, directors, successors, agents and assigns, do not own or operate any entity which provides goods and services for your travel including without limitation, lodging facilities, airline, vessel, motor coach, or other transportation companies, guides or guide services, local ground operators, providers or organizers of optional excursions, food service providers, etc. All such persons and entities are independent contractors and are in no way affiliated to Felix Travel or any of Felix Travel’s affiliated entities.

Liability: Felix Travel is not liable for any negligent or willful act or failure to act of any travel service provider or of any third party. In addition and without limitation, Felix Travel is not responsible for any injury, loss, death, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services whether resulting from, but not limited to, acts of God or force majeure, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation, or for any failure of any transportation mechanism to arrive or depart on time. Also be advised that certain foreign facilities such as air-conditioning systems in public places, hotels and motor coaches may not be up to U.S. standards. If due to weather, flight schedules or other uncontrollable factors you are required to spend additional night(s), you will be responsible for your own hotel, transfers and meal costs. Baggage is entirely at owner’s risk. The prices of any local tour are based on rates in effect (including foreign exchange rates) at the time of printing and are subject to change without notice. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. You specifically agree that Felix Travel is not liable for any consequential loss or damage.

Passports: All individuals departing from the United States of America must be in possession of a valid passport. It is your responsibility to ensure that you have valid travel documentation, including but not limited, to passports and visas, which meet the requirements of immigration and other government authorities at every destination. You are responsible for confirming with the United States Department of State, or representative government agency of the country to which you are traveling, to confirm the requirements for visas, and/or other requirements, for admission to your destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. A government issued ID is required for travel within the USA.

Travel Documents: Travel documents include, without limitation, airline tickets, hotel vouchers, tour vouchers, or any other document (whether in electronic form or otherwise), used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions such as, but not limited to, being nonrefundable, non-date-changeable, and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings on your documentation will be your responsibility, if Felix Travel is not advised at the time of booking. Felix Travel does not guarantee that travel arrangements can be made with, or under, names not matching the passport or other government issued I.D.

Health and Special Requirements: It is your responsibility to ensure that you are aware of any health requirements for your travel destinations and to ensure that you carry all necessary vaccination documentation. Please advise your consultant of any special requirements you may have, for example, special meals, medical requirements and so on. Felix Travel is not responsible for the lack of any availability of any needed medical facility, treatment, medical provider, mediation or pharmacy during your travel.

International Flights: Some countries require insecticide spraying of aircraft prior to a flight or while you are on the aircraft. Please see the Department of Transport disinsection website for more information.

Refusal of Service: Service providers reserve the right to refuse service to travelers at their sole discretion and including without limitation if the traveler:

Lacks proper documentation for the country of destination;

Has a contagious disease;

Is under the influence of alcohol, drugs or narcotics; and/or

manifests disruptive and/or unruly behavior

Felix Travel assumes no liability for the acts of the service provider in refusing service.

Privacy Policy: Felix Travel is committed to protecting the privacy and confidentiality of your personal information. You may view of complete Privacy Policy on our website.

Booking Procedure: At the time that Felix Travel receives your itinerary request form, (hereinafter referred to as “Itinerary Request”), and the initial Booking Fee, Felix Travel will commence processing your Itinerary Request. Felix Travel will then notify you, by e-mail the estimated cost of your trip itinerary. Felix Travel will send you your complete trip itinerary and booking information approximately 25-30 days prior to departure, or sooner if your departure date is less than that time

The total amount of the cost will depend on the rates that we will be able to negotiate with vendors. Felix Travel will make its best efforts to obtain the best available prices and rates from all Vendor involved in your travel.

Felix Travel cannot guarantee the cost of any specific travel booking, such as airfare, hotel charges or tour costs, until the booking is actually completed and payment received by the vendor. You hereby acknowledge, understand and agree that, due to constant changes in airfares, hotel and tours costs, the final cost of your trip itinerary may be somewhat different than, and may exceed, the estimated cost initially provided to you by Felix Travel. Any such increase in the cost shall be borne by you.

All payments made by you to Felix Travel shall be made in U.S. Dollars (USD). Thus, any and all Vendors’ payments, if they are in different currency, will be converted into U.S. dollars at the exchange rate in effect at the time such reservation/cancellation/change is made.

Booking Procedure for Personalized Complete Travel Packages:

We offer selected ‘One Price’ personalized complete Travel Packages, in which you tell us your European travel interests and we prepare the itinerary with your maximum enjoyment in mind. You will also have a range of transportation and hotel accommodations in which to choose. We prepare the itinerary, based upon your interest, and you will be able to select the manner of transportation and quality of hotel accommodations that you prefer.

To book a personalized and complete European travel package, fill out the Form with your ideas for the trip. We will prepare a preliminary itinerary for you to review. If the itinerary looks acceptable to you (you will be able to modify it later, if you choose), you pay the initial booking fee, under ‘Pricing’ on our website, and we start working on putting together your package. After we prepare the personalized travel package we will advise you of the cost for the total package. After the initial proposed itinerary is prepared, a non-refundable ten (10%) deposit is required if the trip is to commence more than ninety (90) days from departure. The itinerary can be modified by you, however, such modification may result in the total package cost being more than originally stated. The remaining amount of the package cost is due ninety (90) days prior to departure. If the package is booked within ninety (90) days of departure, the entire amount of the package cost is due at booking. Other terms, conditions and procedures are the same as with other bookings, and are as set forth in this Booking Terms & Conditions Agreement.

Trip Itinerary Modification and Cancellation

Trip Itinerary Modification by You: If you need to change or modify your trip itinerary, or any reservation or details thereof, please notify Felix Travel immediately. In the event such a change or modification is permitted by the vendor(s), a change fee may be charged by the v and by us. The amount of the fee may depend upon the circumstances of the reservation(s) and the change requested. In the event that the change or modification request is made prior to Felix Travel completing the reservation(s), no extra fees will be assessed.

In the event that the change or modification request is received after Felix Travel has completed the reservation(s), Felix Travel shall make its best efforts to change or modify such reservation(s) or cancel such reservation(s) and substitute it with a new reservation(s) made in accordance with the new details/changes provided by you. Felix Travel may charge you a change fee in an amount of $30.00 Dollars (USD) per change request, plus any fees charged by the vendor(s). Felix Travel does not guarantee that any vendor will issue a refund after a reservation has been made and Felix Travel shall not be liable to you in the event that any Vendor’s refuses to issue any such refund. The initial Booking Fee is non-refundable.

Please note that all reservation changes or modifications are subject to (i) availability, and (ii) the terms and conditions of the vendor(s). Please note, that name changes and other details may not be allowed by many airline and other vendors. Felix Travel will endeavor to make such a change or modification, if requested, however you are advised that most airlines or other Vendors treat a name change as a reservation cancellation, to which standard cancellation charges may apply. If you decide not to take any of the booked flights, please contact Felix Travel, or the relevant airline, as far in advance as possible, such that you may have some options. If you do not check in on time for a confirmed flight reservation, the airline may register you as a ‘no-show’, which could result in rendering your ticket void.

Itinerary Cancellation by You: If you need to cancel your entire trip itinerary, or any part thereof, please notify us immediately. If you cancel the entire trip itinerary, or any part thereof, you may be entitled to a partial refund. However, all cancellations are subject to the terms and conditions of the vendors, which provide you with travel services. In addition to the cancellation charges/fees applied by the vendor(s), Felix Travel’s cancellation fees may also apply. Please note that, in most cases, airline/flight tickets (consisting of more than one flight) cannot be refunded if they have already been partially used. Any refund issued by a vendor will be paid to you by Felix Travel only after receipt of the same form the vendor(s). Felix Travel does not guarantee that any vendor will issue a refund after a reservation has been made and Felix Travel is not liable to you in the vent that a Vendor’s refuses to issue a refund to you. The initial Booking Fee is non-refundable. Please note that in the event of cancellation of your trip itinerary and if you purchased the travel insurance, the cancellation may be covered under the terms of your travel insurance policy. You may, in that event, be able to claim a refund for the cancellation from the travel insurance company.

Itinerary Cancellation by Felix Travel: Felix Travel reserves the right to treat any Itinerary Request as cancelled if any balance due by the Customer is not paid to Felix Travel on time and in such event, Felix Travel’s and the vendors’ cancellation fees may apply.

Itinerary Modification or Cancellation by Vendors: Any contract between you and any vendor may allow such vendor to cancel or amend your bookings. Felix Travel will ensure that you are promptly notified of any significant change as soon as Felix Travel becomes aware of any such change, but Felix Travel shall have no liability for any such changes, or costs that you may incur as a result of the vendors’ actions. Subject to the vendor’s terms and conditions, you may then have the option of either (i) accepting the change, or (ii) accepting an offer of alternative travel arrangements, in the event that one is made available by the vendor, or (iii) canceling your booking and receiving any applicable refunds from such vendor. Felix Travel does not guarantee that any refunds will apply. Felix Travel has no control over airline schedule changes and shall have no liability for expenses or inconvenience that may arise as a result of any such changes made by any such vendor. We strongly recommend that you contact your airline at least 72 hours prior to the scheduled departure time of each flight to confirm the flight schedule and time. Please note that some airlines require their customers to confirm their flight reservations. Please make sure that you have provided us with your contact email address and that you regularly check your e-mail for new messages.

OTHER DOCUMENTS. The website, europecharm.com has, as an integral part of its website rules and procedures, a Website Terms and Conditions document and a Privacy Policy, which are shown on the website. All of the terms, conditions, information and provisions included in such Website Terms and Conditions document and the Privacy Policy are expressly incorporated into this Booking Terms & Conditions document, the same as if they were set out in full herein and all such terms, conditions, information and provisions of such documents apply also hereto
